Terms of Service

1. Scope and Acceptance

1.1These Terms of Service (the “Terms”) form a binding agreement between you and DealsonMeals LLC, a Minnesota limited liability company (“DealsonMeals,” “we,” “us,” or “our”).

1.2These Terms govern your use of our website at dealsonmeals.app (the “Site”) and of the DealsonMeals mobile application for iOS and Android (the “App”). The Site and the App are referred to together as the “Services.” Where a term applies to only one of them, these Terms mark it App only or Site only.

1.3By accessing or using the Services, you accept these Terms. If you do not accept them, do not use the Services. Our Privacy Policy is incorporated into these Terms by reference.

1.4The Services are offered only in the United States and are intended only for users located in the United States.

2. What DealsonMeals Is

2.1DealsonMeals is an independent informational service that collects and displays dining deals and promotions offered by restaurants and restaurant chains in the United States. We compile this information from publicly available sources.

2.2We are not affiliated with, endorsed by, sponsored by, or acting as an agent, representative, or partner of any restaurant or brand appearing in the Services, except where a placement is expressly identified as sponsored or featured. We do not create, control, fund, or honor any offer shown in the Services.

2.3Every offer is made by the restaurant, not by us. Whether an offer is honored, and on what conditions, is determined solely by the restaurant. Any transaction you enter into is between you and the restaurant, and we are not a party to it.

3. Eligibility

3.1You must be at least thirteen years old to use the Services and to create an account. By using the Services you represent that you meet this requirement, that you are located in the United States, and that you have the capacity to enter into these Terms.

3.2If you are under eighteen, you may use the Services only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.

4. Your Account

4.1Some features require an account. You may register with an email address and password, or through Apple or Google. You agree to provide accurate information and to keep it current.

4.2You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without your authorization.

4.3You may close your account at any time from the settings screen in the App or from your account settings on the Site. Closure is immediate and permanent, and it deletes the information described in our Privacy Policy. It cannot be undone.

5. License to Use the Services

5.1Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Services for your own personal, non-commercial purposes. App only The App is licensed to you, not sold, and you may install and use it only on a device you own or control.

5.2You may not copy, modify, translate, or create derivative works of the Services; reverse engineer, decompile, or disassemble any part of them, except where that restriction is prohibited by law; rent, lease, lend, sell, sublicense, or otherwise transfer them; or remove or obscure any proprietary notice.

5.3The App is provided free of charge and contains no in-app purchases and no subscriptions. We may introduce paid features in the future, in which case we will present their terms and price before you incur any charge.

5.4App only The App may download and install updates automatically, in accordance with your device settings. Some updates may be required for the App to keep working. You are responsible for any device, carrier, and data charges you incur in using the Services.

6. Deal Information

6.1Deals, promotions, prices, and other offer details shown in the Services are compiled from publicly available sources and may change, expire, or be withdrawn at any time without notice. Offers frequently vary by location, by day and time, by participating franchise, and by conditions the restaurant sets, including requirements to use its own app or loyalty program.

6.2Where the Services indicate that an offer is available only at particular locations, or show a restaurant location on a map, that information reflects our best understanding at the time and may be incomplete or out of date. A location shown may have closed, moved, or never have participated in the offer.

6.3We do not warrant that any offer is currently valid, available, accurately described, or redeemable. Confirm the terms of an offer directly with the restaurant before relying on it. We are not responsible for any cost, loss, wasted journey, or disappointment arising from an offer that is inaccurate, expired, altered, or refused.

7. Content You Submit

7.1The Services let you submit deals and, in some places, write short comments such as a reason for voting a deal down. Everything you submit is “Your Content.”

7.2You warrant that Your Content is accurate to the best of your knowledge, is drawn from publicly available information, and does not infringe anyone’s rights or violate any law. Do not include personal information about yourself or any other person in Your Content.

7.3You retain ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, store, reproduce, modify, edit, publish, and display Your Content in connection with operating and promoting the Services.

7.4We are under no obligation to publish, respond to, or credit any submission, and we may verify, edit, reject, or remove any submission at any time and for any reason.

7.5If you send us suggestions or feedback about the Services, we may use them without restriction, attribution, or compensation.

8. Acceptable Use

8.1You agree not to:

• use the Services for any unlawful purpose, or in breach of these Terms;
• submit information you know to be false or misleading;
• impersonate any person or misrepresent your affiliation with anyone;
• access or attempt to access another user’s account, or any system or data you are not authorized to access;
• scrape, crawl, harvest, or systematically extract data from the Services, or use any automated means to access them, except as a search engine indexing publicly available pages;
• interfere with, disrupt, overload, or circumvent any part of the Services, including rate limits and other protective measures; or
• use the Services to build or improve a competing product or dataset.

9. Third-Party Services and Links

9.1The Services link to third-party websites and, where you have the relevant application installed, may open a restaurant’s own mobile application on your device. We provide these links for convenience. We do not control third-party services and are not responsible for their content, accuracy, availability, or privacy practices. Your use of them is at your own risk and subject to their terms.

9.2Maps, directions, sign-in, and notification delivery are provided through third parties identified in our Privacy Policy, and your use of those features is also subject to their terms.

10. Intellectual Property

10.1The Services, and all original content, software, design, text, graphics, and layout in them, including the DealsonMeals name and logo, are owned by DealsonMeals LLC and are protected by copyright, trademark, and other laws. Except for the license in Section 5, no right in them is granted to you.

10.2Restaurant names, logos, trademarks, and promotional images appearing in the Services are the property of their respective owners and are used for identification and informational purposes only. Their appearance does not imply any affiliation with, endorsement by, or sponsorship by those owners.

11. Copyright Complaints

11.1If you own rights in material displayed in the Services and believe it is being used improperly, contact us as described in Section 20 with a description of the material, its location in the Services, the basis for your claim, and your contact details. We will review and respond promptly, and will remove material where appropriate.

12. Suspension and Termination

12.1We may suspend or terminate your access to the Services, in whole or in part, at any time and without prior notice, if we reasonably believe you have breached these Terms or that your use is harmful to the Services, to other users, or to us.

12.2We may modify, suspend, or discontinue any part of the Services at any time. We will not be liable to you for doing so.

12.3Sections 2, 6, 7.3, 10, and 13 through 19 survive termination.

13. Disclaimer of Warranties

13.1The Services are provided “as is” and “as available,” with all faults and without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express, implied, and statutory, including the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.

13.2Without limiting the foregoing, we do not warrant that the Services will be uninterrupted, secure, or error-free, that any defect will be corrected, or that any information in the Services — including any offer, price, restaurant location, or expiry date — is accurate, complete, or current.

13.3Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

14. Limitation of Liability

14.1To the fullest extent permitted by law, DealsonMeals LLC and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to the Services or these Terms, whether in contract, tort, or otherwise, and whether or not we were advised of the possibility of such damages.

14.2To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Services or these Terms will not exceed one hundred United States dollars (US$100).

14.3These limitations apply even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

15. Indemnification

15.1You agree to indemnify and hold harmless DealsonMeals LLC and its members, managers, employees, and agents from any claim, demand, loss, liability, and expense, including reasonable legal fees, arising out of your use of the Services, Your Content, or your breach of these Terms or of any law or third-party right.

16. Additional Terms for the App — Apple App Store and Google Play

16.1This Section applies if you obtained the App from the Apple App Store, and prevails over any conflicting term in these Terms in that case.

16.2These Terms are concluded between you and DealsonMeals LLC only, and not with Apple Inc. (“Apple”). DealsonMeals, and not Apple, is solely responsible for the App and its content.

16.3The license granted in Section 5 is limited to a non-transferable license to use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you through Family Sharing or volume purchasing.

16.4Apple has no obligation to furnish any maintenance or support services for the App.

16.5In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you, if any. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claim, loss, liability, damage, cost, or expense attributable to a failure to conform to any warranty is the sole responsibility of DealsonMeals.

16.6DealsonMeals, and not Apple, is responsible for addressing any claim relating to the App or your possession or use of it, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.

16.7In the event of any third-party claim that the App or your possession and use of it infringes that third party’s intellectual property rights, DealsonMeals, and not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.

16.8You represent that you are not located in a country subject to a United States Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any United States Government list of prohibited or restricted parties.

16.9You must comply with any applicable third-party terms of agreement when using the App.

16.10Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of them Apple will have the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

16.11If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and has no responsibility for the App.

17. Governing Law and Venue

17.1These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of law provisions.

17.2You and DealsonMeals agree that the state and federal courts located in Minnesota have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and you consent to personal jurisdiction and venue in those courts.

18. Changes to These Terms

18.1We may revise these Terms. When we do, we will update the dates at the top of this page, and where the change is material we will give notice through the Services before it takes effect. Your continued use of the Services after a revision takes effect constitutes acceptance of it. If you do not accept a revision, stop using the Services and close your account.

19. General

19.1These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Services and supersede any prior agreement on that subject.

19.2If any provision is held unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed, and the remaining provisions will continue in full force.

19.3Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. There are no third-party beneficiaries to these Terms except as stated in Section 16.
